These Terms of Service (“Terms”) govern your use of BuyerPath. By creating an account or using the service, you agree to these Terms. Please read them carefully.

1. What BuyerPath is

BuyerPath is a software tool that helps real estate professionals stay connected with the home buyers and sellers they work with — through a shared dashboard, readiness insights, home search, messaging, and AI assistance. BuyerPath is not a real estate brokerage, mortgage lender, broker, or financial, legal, or tax advisor, and is not a party to any real estate transaction.

2. Eligibility

You must be at least 18 years old and able to form a binding contract to use BuyerPath.

3. Accounts

Access is by invitation from a real estate professional. You agree to provide accurate information, keep your password secure, and accept responsibility for activity under your account. Notify us promptly of any unauthorized use.

4. The agent–client relationship

BuyerPath facilitates communication between an agent and their clients. Any professional relationship, agreement, or transaction is solely between you and the other party. BuyerPath does not provide real estate, lending, or financial services and does not control or guarantee the conduct of any agent or client.

5. AI features

BuyerPath uses AI (Google Gemini) to provide chat and insights. AI output is generated automatically, may be inaccurate or incomplete, and is for informational purposes only — it is not financial, legal, tax, or real-estate advice. Always verify important information and consult a qualified professional before making decisions.

6. Property listings

Home-search results and listing details are provided by third-party data sources for convenience. We do not guarantee their accuracy, availability, or completeness, and inclusion of a listing is not an endorsement. Always confirm details with the listing source or a licensed professional.

7. Acceptable use

You agree not to misuse the service, including: violating any law; infringing others’ rights; accessing data you are not authorized to; scraping or harvesting data; interfering with the service’s operation or security; or using it to harass others. Agents are responsible for complying with all applicable laws and professional obligations — including fair-housing and licensing requirements — in their use of BuyerPath.

8. Privacy

Your use is also governed by our Privacy Policy, which explains how we handle information — including the boundary that keeps clients’ raw financial details private from agents.

9. Fees

BuyerPath may offer paid plans for agents. Any fees, billing terms, and trials will be disclosed before you incur a charge. Where access is provided at no cost, we may change or end that arrangement on reasonable notice.

10. Intellectual property

BuyerPath and its content are owned by us or our licensors and are protected by law. We grant you a limited, non-exclusive, non-transferable license to use the service for its intended purpose. Content you submit remains yours; you grant us a license to use it as needed to operate the service.

11. Termination

You may stop using BuyerPath and delete your account at any time. We may suspend or terminate access if you violate these Terms or to protect the service or other users.

12. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT ANY OUTCOME (SUCH AS BUYING OR SELLING A HOME) WILL BE ACHIEVED.

13. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BUYERPATH AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US IN THE PRIOR 12 MONTHS OR $100.

14. Indemnification

You agree to indemnify and hold BuyerPath harmless from claims arising out of your use of the service or your violation of these Terms.

15. Changes

We may update these Terms from time to time. Continued use after changes take effect means you accept the updated Terms.

16. Governing law

These Terms are governed by the laws of the State of Wyoming, without regard to its conflict-of-law rules.
